国务院总理(Premier of China's State Council)温家宝(Wen Jiabao)日前签署国务院令[1],公布《女职工[2]劳动保护特别规定[3]》。《规定》指出,用人单位[4]不得因女职工怀孕[5]、生育[6]、哺乳[7]降低其工资、与其解除[8]劳动。
女职工生育享受98天产假[9],其中产前可以休假15天;难产的,增加产假15天;生育多胞胎[10]的,每多生育1个婴儿,增加产假15天。女职工怀孕未满4个月流产[11]的,享受15天产假;怀孕满4个月流产的,享受42天产假。
《规定》指出,在劳动场所[12],用人单位应当预防对女职工的性骚扰[13]。
State Council Premier Wen Jiabao signed a State Council decree several days ago, publicly issuing the "Special regulations to protect women workers". The regulation indicates that employing units are not allowed to reduce the salary and dismiss women because of pregnancy, giving birth or breast-feeding.
Women workers enjoy 98 days of maternity leave, and additional 15 days before giving birth. If the birth is difficult, 15 more days can be added, and if it is a multiple birth, for every additional fetus 15 days of vacation are added. If women workers undergo abortion in the first four months of pregnancy they can enjoy 15 days of maternity leave, and if they abort the fetus later in the pregnancy, they can take 42 days of maternity leave.
The regulation indicates that the employing unit must guard against sexual harassment of women at the working place.
